Sexual Citizenship: An Interpretive Principle of Equality

This article provides an overview of the concept of sexual citizenship present in many Brazilian court decisions about same-sex unions. This principle has been used by our courts as a substantive parameter of judicial review, but has not yet received an adequate formulation. The absence of a clear definition of this normative parameter justifies this intellectual endeavor because its relevance transcends the discussions about access to spousal rights. We think that it can operate as a counterpoint to the current political mobilization around the legal status of sexual minorities, a movement that seeks to reverse important political victories in recent decades. This paper examines the notion of sexual citizenship based on theoretical developments in the fields of constitutional law and political science as well as in national and international court decisions about sexual minority rights. Although its significance remains concealed because of the understanding of citizenship as a mere legal and political status, this concept identifies a very relevant way of belonging in contemporary societies.References
