Abstract: This article aims to understand what should be understood empirically by argumentation. It can be said that the overwhelming majority of authors who are interested in argumentation theory remain attached to the canons created from Aristotle's Rhetoric. This means taking a methodologically normative perspective, that is, the authors discuss how they think argumentation should be and not how it actually happens. This paper appeals to the tradition prior to Aristotle and defends the thesis that argumentation goes far beyond persuasion, because the human discourse is also constituted by other linguistic ways and actions in which the speaker does not aim to convince the participants. Methodologically it adopts a descriptive stance and seeks to explain the different ways in which the discourse effectively occurs, leaving in a secondary place the opinion of each author on how it should be.

Keywords: realistic legal rhetoric, argumentation, eristic, persuasion.
