This text distinguishes allocative and constructive approaches to Justice, to situate Forst and Fraser in the second group and to show the compatibility of this classification, formulated by Rainer Forst, with Nancy Fraser's reflections on the scales of justice. Next, the text responds an objection by the allocative theories of justice, regarding the treatment of those with special mental needs, in a dialogue with the work of Martha Nussbaum.
