Interdisciplinaridade e direito comparado: da necessidade à inevitabilidade

The paper aims to investigate the relationship between interdisciplinarity and comparative law, starting from the hypothesis of the “inevitability thesis”, pointing out bases for an interdisciplinary approach in legal research. To this end, interdisciplinarity is examined as an attitude, a procedure and a method, highlighting its relevance in overcoming the “authority paradigm” and reconfiguring legal thinking based on the challenges and benefits of integrating knowledge from different disciplines, such as psychology, sociology, history and other disciplines, in order to understand normativity and legal cultures, especially in comparative law, which demands an open epistemological approach, valuing the plurality of perspectives and contextualization in order to produce innovations. The study adopts a descriptive and analytical methodology, prioritizing a qualitative bibliographic reference, with a “legal-descriptive” and “legal-propositional” nature, based on the hypothetical-deductive method, in an attempt to confirm or refute the “inevitability thesis” outlined.
