Consciência jurídica, confiança e Bitcoin: pressupostos para a criação de uma nova moeda.

Resumo

Resumo: O presente artigo investiga como a consciência jurídica de usuários e entusiastas de Bitcoin no Brasil penetra simbolicamente nesse campo social estruturando e conformando as decisões dos atores individuais de comprar, usar e investir na tecnologia. Ao todo, trinta e nove usuários e entusiastas de Bitcoin foram entrevistados. As trinta e nove transcrições foram codificadas e analisadas por meio do método de grounded theory. Ao final, chegou-se à obtenção de três esquemas interpretativos por meio dos quais a consciência jurídica dos entrevistados se expressa e afeta, como consequência, as suas decisões individuais. Os esquemas interpretativos foram nomeados de 1) o direito como uma ferramenta utilitária; 2) o direito como um provedor de segurança; e 3) o direito como uma ferramenta política. Da obtenção dos resultados, chegou-se à constatação de que mesmo em campos sociais onde o direito é ativamente contestado e rejeitado, ele ainda assim representa um componente estruturante das relações sociais com relevante poder de conformação de comportamentos.

Abstract: This article investigated how Bitcoin users' and enthusiasts' legal consciousness symbolically penetrates this social field in Brazil by structuring and shaping individuals' decisions to buy, use and invest in the technology. Thirty-nine Bitcoin users and enthusiasts were interviewed. The thirty-nine transcripts were coded and analyzed using grounded theory. In the end, three distinct interpretative schemas were obtained through which the interviewees' legal consciousness is expressed and affects, as a result, their individual decisions. The interpretative schemas were named 1) law as a utility tool; 2) law as a security provider; and 3) law as a political tool. From the findings, one comes to the conclusion that even in social fields where the law is actively contested and rejected, it still represents a structuring component of social relations with relevant behavioral shaping power.
